Hey, how do we get this update, the legal way?

What do we need to do?

Does the sim card have to always be on the phone, or is WiFi good enough?

Well the network 1. has to always be connected. 

2. Anyway you get it is legal.  it's opensource.  You are hacking freeware by rooting and going around them.  What we have is developer kits on our phones.  If you want to not do anything and just have a regular ole G1, then wait for the OTA.  If you want to see what the DREAM has to offer, root and come check out what we are doing.

Cool!, I am reading all these tutorials, sorry I am a A+ Certified, almost got a CCNA, and this is driving me crazy that I cant figure this out.

Playing with the iPhone was easier then this lol

Ok, so by network, the T-Mobile network? or is WiFi fine?

Cuz my sim card is in my iPhone, I can take it out if need be.

You have to have the sim in your G1.  The network won't recognize you need an update unless it can read your phone. 
And if you have any unix or linux background, it will make it easier.  if you don't the tuts are specific and to the point. so you can do it without worry. 
I'm an IT of 15 yrs and read the tutorials and were lost too, but as i did it and realized the phone is the same as a computer, it was rather easy.   Any of these process, ie rooting; apps 2 sd; boot screens, are all written in Barney language so that anybody can understand them.

That i would have to ask.  i would venture to say, it doesn't matter.   you get a text message from TMO saying that you have an update for download. So as long as you are on the TMO network, i'd guess it wouldn't matter if you were on wifi.

IN LAMENS:  As long as you can get text messages, you should get the link for the OTA.

it doesn't matter if your on wifi, edge, 3g, gprs, tmobile, at&t. vodaphone just as long as you have a active sim card with data service you will receive ota updates
